2 Minn. men to be tried in ND for attempted murderBISMARCK — A North Dakota judge says there is enough evidence against two Minnesota men to try them on attempted murder charges in connection with the beating of a Bismarck man.
Thirty-three-year-old Jose Nelson Osorio and 19-year-old Kelvin Rolando Osorio Oviedo pleaded not guilty to the charges Friday after Judge David Reich ruled there was probable cause for the charges, following a preliminary hearing.
Police detective Joe Arenz testified that 25-year-old Rafael Angel Diaz Zayas was repeatedly beaten and stabbed nine times between the night of June 11 and morning of June 12 at an apartment.
Arenz says Osorio acknowledged to beating and stabbing what he thought to be a shadow and Oviedo also used dumb bells in the attack.
Osorio and Oviedo were later arrested in Douglas County, Minn.
