Jamestown adult entertainment ordinance requires adjustment

JAMESTOWN, N.D. - An ordinance concerning adult cabarets and escort services in Jamestown city limits will require additional adjustments before final consideration.

The topic was discussed Wednesday during the Jamestown Finance and Legal Committee meeting. A second reading of the ordinance is planned for the July 1 City Council meeting.

As written, the ordinance requires adult cabarets or strip clubs to be 1,200 feet from any churches, schools and residences and located in an area zoned M2 Industrial.

“There is no place in Jamestown that meets those requirements,” said City Administrator Jeff Fuchs.

City Attorney Ken Dalsted said zoning regulations that eliminate the possibility of an activity can be challenged in court.

“We’re looking for something that doesn’t zone it out of existence but provides the maximum protection,” said Mayor Katie Andersen.

Fuchs said most of the property with an industrial zoning is along the railroad corridor that runs through the center of the city.

City staff was directed to prepare maps with concentric circles indicating distances of 1,200 feet and lesser distances that could be discussed at the next City Council meeting to determine what distance could be used.

The topic was advanced to the July 1 meeting for further review by a 4-0 vote.
