Fargo woman charged with 1997 sex assault

FARGO – A 38-year-old Fargo woman is accused in Cass County District Court of having sex with a 14-year-old boy more than 15 years ago. Charges were filed after police say a DNA test showed the boy fathered a child with the woman.

According to reports filed with the charges Thursday, police began investigating last April, when the alleged victim – who is now either 29 or 30 years old – told police Carrie Jean Berg molested him for years, starting when he was 9 or 10 years old and continuing until he was 14 or 15 years old.

The alleged victim is someone Berg knows. The Forum typically does not identify people who allege they are victims of sexual abuse.

Police say a DNA test shows the alleged victim is the biological father of a child of Berg. Investigators allege the child would have been conceived in 1997 sometime between July and September.

According to police reports, Berg, who was 22 years old at the time, reported to West Fargo police in September 1997 that the 14-year-old boy had sexually assaulted her.

But when asked by a police detective in an interview in December 2012, Berg said it was possible they had sex without any forcing – though she later said she didn’t know, court records state.

Prosecutors filed charges of gross sexual imposition, one count as a Class AA felony and one as a Class A felony. A conviction on the Class AA charge carries a minimum prison sentence of five years followed by from five to 10 years of supervised probation.

A warrant was issued Friday for Berg’s arrest.

Ryan Younggren, the assistant Cass County state’s attorney prosecuting the case, said while the statute of limitations for gross sexual imposition is seven years, the deadline for filing charges when the allegations involve a juvenile victim is three years from the time the alleged offense is first reported to law enforcement.
