Victim in landlord assault case suesFARGO – The West Fargo landlord whose conviction was recently upheld for running over his former tenant with a Hummer is now being sued by the victim in civil court for personal damages.
Brian Hemphill is asking for $50,000 or more from 75-year-old Alois Vetter for what he “suffered and continued to suffer in economic and non-economic damages,” according to court documents.
Vetter was sentenced to serve two years for aggravated assault for running over Hemphill in the street near Vetter’s rental property in the 600 block of Second Street West in October 2011 in West Fargo.
The civil suit was filed in Cass County court the day after the North Dakota Supreme Court upheld Vetter’s conviction on the grounds that a Hummer constitutes a dangerous weapon.
