Appeals court rules against West Fargo man in child porn case
A jury in October 2011 found Scott Boyle, of West Fargo, guilty on charges of sexual exploitation of minors and possession of pornography. He was sentenced to 15 years in prison.
Prosecutors say that between 2006 and 2010, Boyle videotaped two underage girls in a bathtub and while they were playing naked in a bedroom in Boyle's home.
Boyle argued in his appeal that the jury was not given proper instructions, the evidence did not support the charges, and the tapes did not show sexually explicit conduct.
The 8th U.S. Circuit Court of Appeals ruled against Boyle's request for acquittal or a new trial.
