On night of birthday, Fargo man allegedly assaults bouncer, spits on police
Timothy Lynn Porter is charged in Cass County District Court with contact by bodily fluids and simple assault on a peace officer, both felonies, and misdemeanor simple assault.
Officers were called about the assault at Big D’s Bar & Grill, 1515 42nd St. S., at 12:58 a.m. Friday.
Porter’s birthday was Thursday.
The bouncer told police Porter got into a fight and he broke it up. He said Porter started to walk away as requested but then came back toward him and tried to punch him, the police report states.
Porter missed with the punch but allegedly hit the bouncer in the throat and grabbed and squeezed his throat. The bouncer placed Porter under citizen’s arrest until police arrived and handcuffed him, the report states.
As officers escorted Porter to the car, he allegedly kicked one officer in the upper thigh and spit in the other officer’s face.
Each felony charge carries a maximum penalty of five years in prison and a $5,000 fine.
Porter remained in the Cass County Jail on Monday.
