Injunction allows Fantasy's to open in East Grand ForksGRAND FORKS - A federal judge has allowed an adult-themed store to stay open in East Grand Forks while until a court determines whether it will be allowed to set up permanently in a commercial zone.
In a preliminary injunction filed Wednesday in U.S. District Court in Minneapolis, Judge John R. Tunheim allowed Fantasy’s to stay open while the case is pending, despite East Grand Forks’ claim that the store was “adult use” and needed to move to an industrial zone.
The store was open Thursday, but East Grand Forks city administrator Scott Huizenga said it still doesn’t have an approved site plan for the space at 207 Second Ave. N.E.
“We’re still under the auspices of our city code,” Huizenga said. “What’s on the books is what we stand by.”
The business attempted to open in East Grand Forks in May after the Grand Forks City Council pushed the store out of a location in the city in April with an ordinance restricting where sexually-oriented businesses can operate.
