Man charged with assault in Fargo park

FARGO – A Fargo man is accused of sexually assaulting a woman in a park here after fellow campers reported they saw him allegedly hitting the woman in the face.

Police reports say officers responded to a domestic call in Lindenwood Park on Tuesday after a park employee said he saw a man beating up a woman near a camper.

When officers spoke to the woman, she said the man forced her to have sex with him in the morning and punched her in the face several times throughout the day. She said the man told her he would kill her if she left or told anyone about the incident, court documents said.

Thursday, Andrew Mark Vivier, 44, was charged in Cass County District Court with gross sexual imposition, a class AA felony, as well as a class C felony charge of terrorizing and a misdemeanor charge of simple assault.

Bail was set at $100,000 and a no contact order was issued between Vivier and the woman.

Vivier will appear next in court on Aug. 16.

In 2009, Vivier was stabbed by his roommate in the Moorhead home they shared, according to Forum archives.

In 2011, he was stabbed in the back of his leg, by a woman who said in court records that Vivier broke her dog’s rear leg.
