Rape charge against Fargo man dismissedFARGO – Prosecutors have dismissed the charge against a 47-year-old Fargo man accused of raping an unconscious woman at his apartment here last September.
The gross sexual imposition charge filed against Allen Cooper on March 21 in Cass County District Court was dismissed on April 27.
“Upon further investigation the State does not believe it would be able to prove the case beyond a reasonable doubt,” states the motion to dismiss, signed by Assistant State’s Attorney Leah Viste.
Cooper’s attorney, Laura Reynolds, of Fargo, said Friday the credibility of the alleged victim and witnesses was “very poor.”
The Class AA felony charge carried a mandatory minimum sentence of 20 years in prison.
