Five charged on allegations of sexual contact with teen girlsFARGO – Five adult teenagers from Fargo and West Fargo have been charged with having sexual contact with a 13-year-old girl or 14-year-old girl, or both, last summer.
Because the suspects were 18 or 19 years old at the time and the alleged victims were under 15, the gross sexual imposition (GSI) charge is a Class A felony punishable by mandatory registration as a sex offender and up to 20 years in prison, prosecutor Ryan Younggren said.
Arrest warrants were issued Thursday for all five men.
Younggren, an Assistant Cass County State’s Attorney, said the charges don’t allege forced sexual contact. The age difference between the adults and minors “is the crux of the case,” he said.
According to a Fargo police report filed with the charges:
A detective received a report from social services about the two girls having sexual contact with older males in June 2011 in the 4600 block of San Juan Drive in Fargo.
During an interview at the Red River Children’s Advocacy Center in Fargo, the 14-year-old girl told the detective there were multiple occasions in which she and the 13-year-old girl met with the group of males.
She described several sex acts that took place between the girls and men in Fargo, West Fargo and Christine, N.D., the police report states.
Jean De Dieu Nizeyimana of West Fargo was charged with two counts of GSI for alleged sexual contact with the 14-year-old in a vehicle near the 45th Street South dog park in Fargo and at Buena Vista Manufactured Home Community between May 1 and August 24 of last year. He told police he believed the girl was 17, the report states.
Sadam Adow Sufi of West Fargo also faces two counts for alleged sexual contact with the 14-year-old girl in the 1300 block of Sixth Street East in West Fargo and in a vehicle near the dog park.
His brother, Deqow Sufi of West Fargo, faces one count for alleged sexual contact with the same girl at the same West Fargo apartment.
Korsiba Ali Arot of Fargo is charged with three counts – one involving the 13-year-old and two involving the 14-year-old. Arot denied any sexual contact with the younger girl, the report states.
Adan Abdi faces a single count for alleged sexual contact with the 13-year-old. He told police he didn’t know the girl was 13 and thought she was his age, the report states.
A 26-year-old man who also was named as a suspect in the report denied knowing who the girls were, but said he did give Nizeyimana a ride to visit the 14-year-old, the report states. He claimed he only talked to the 13-year-old and there was no sexual contact, the report states.
Younggren said information about the 26-year-old was forwarded to Richland County authorities. As of Thursday, the man hadn’t been charged.
If he were to be charged, it would be a Class AA felony punishable by up to life in prison because he was older than 22 when the alleged victim was under 15, Younggren said.
While the alleged sexual contact wasn’t forced, Younggren said, “I’m certainly sworn to uphold the law and enforce the statutes that are there.”
“Those judgment calls will come up possibly during plea negotiations or during sentencing discussions,” he said. “As far as the offenses themselves, this is what the Legislature has laid out for charges in these kinds of activities.”
No attorneys were listed in online court records for the five men charged.
