Fargo police say minor made things worse by fleeingFARGO – Police say a 20-year-old man who would have ended up with just a ticket for underage drinking instead spent the night in jail after he allegedly fled from police late Wednesday.
Fargo Sgt. Mike Erbes said a patrol officer became suspicious when he saw the man and two others walking between parked cars in a north Fargo alley, so he stopped them.
The officer could smell alcohol on Alan Scott Wagner of Fargo and asked if he could look in his backpack, Erbes said. Wagner set down the backpack and took off running, he said.
Wagner twice slipped free of the officer’s grip and hid in a swampy area along the railroad tracks near the North Dakota State University campus, where he eventually surrendered to police shortly before midnight, Erbes said.
Alcohol was found in the backpack, Erbes said.
Wagner was cited for minor in possession/consumption of alcohol and arrested on suspicion of resisting a police officer, Erbes said.
“If he initially would have complied with the officer, the worst thing that would have happened to him is he would have got a ticket,” he said.
