Fargo man sentenced in Facebook pot sting

A 21-year-old Fargo man accused of trying to buy marijuana from an undercover cop he met on Facebook was sentenced to 1½ years of probation Monday.

Benjamin Felch pleaded guilty in Cass County District Court to felony counts of attempting to possess marijuana with intent to deliver and possession of drug paraphernalia, and a pair of drug-related misdemeanor charges.

In court records, prosecutors alleged that Felch went to Oak Grove Park in Fargo expecting to meet up with a woman who said she could provide him pot to sell. He had actually been communicating on Facebook with a Fargo narcotics officer.

On the attempted intent to deliver charge, he was sentenced to 1½ years of probation and a deferred imposition, meaning the conviction will be removed from his record if he completes his probation term, said Tracy Peters, an assistant Cass County state’s attorney.

He was sentenced to 39 days in jail already served for the other three charges, Peters said.
