Fargo group says Smucker violated lease agreementFARGO, N.D. (AP) — A Fargo commercial property group is suing an Ohio company that used to make crustless peanut butter and jelly sandwiches in West Fargo.
Commercial Resource Group, LLC, claims that J.M. Smucker Co. did not give the required notice to end the automatic renewal on its lease of a 38,000-square-feet building in West Fargo. The plant closed earlier this year.
The lawsuit says Smucker has failed to pay monthly rent of nearly $29,000, beginning in July. The Fargo group also claims that its building was damaged when some of the equipment was removed.
Smucker denies that it missed the deadline on the lease and says it did not cause "substantial damage" to the building. The company says the lawsuit should be thrown out of federal court.
