Offender accused again of sex assault to undergo mental examMOORHEAD - After reports from a pair of doctors cleared him as fit to stand trial, a convicted sex offender again accused of sexual assault in Clay County District Court will undergo a second type of competency evaluation.
A doctor will determine if Robert Hersrud under-stood what he was doing at the time of the alleged assaults, Judge Steven Cahill ruled on Monday.
Clay County Attorney Brian Melton said it should take about two months for the report to be returned.
Hersrud faces seven first-degree counts of criminal sexual conduct, accused of molesting an underage boy multiple times while on probation from a 2005 sex-assault conviction involving a 15-year-old girl.
The 26-year-old has brain damage stemming from a childhood injury, accord-ing to court records. In the previous case, the defense had argued unsuccessfully that Hersrud was not competent to stand trial.
