Guard member accused in sexual assault appears in court, posts bail

A North Dakota Army National Guard member from Bismarck has been charged in Cass County District Court with one count of sexual assault in connection with an incident alleged to have occurred early Sunday at a Fargo motel.

Court documents say Scott Allan Dahly, 25, assaulted a woman who was a fellow Guard member in the woman’s motel room.

Police received a report of an assault from the Essentia Health emergency room at 11:08 a.m. Sunday.

Court documents say Dahly, the victim and other Guard members were in town for Guard drill and staying at the motel over the weekend.

The woman told police Dahly forced himself on her sexually after she told him to stop, according to court documents.

She told police that when she later encountered Dahly at drill practice, he told her he hoped they could still be friends and he made statements about seeking treatment for his drinking, the court documents said.

The documents say the woman later told her commanding officer what happened. Guard officials initiated an internal investigation and collected sworn statements.

The statements were later given to police, the documents said.

Dahly made a court appearance Tuesday and conditions for release were set at $4,000 bond or $400 cash bail.

He later bailed out of jail.

Dahly has served in the North Dakota National Guard for eight years and is currently ranked an E-4 specialist, according to a Guard official.
