ND Supreme Court to hear arguments on recall processBISMARCK (AP) — A group that supports the right to recall North Dakota's members of Congress is getting its day in the state Supreme Court next month.
The high court has scheduled arguments Oct. 20 on the dispute between "Recall ND" and Secretary of State Al Jaeger.
The recall process allows voters to force an election for a public official before his or her term is up. Recall ND wants to recall U.S. Sen. Kent Conrad.
Jaeger rejected the recall petition when Attorney General Wayne Stenehjem advised him that members of Congress aren't subject to recall. Recall ND then asked the North Dakota Supreme Court to take up the question.
Conrad's term ends in two years. A recall campaign against him would need almost 79,000 petition signatures.
