Police: Man’s BB gun resembled real pistol

Fargo police arrested a 36-year-old Fargo man early Friday morning after he pointed a BB gun at another man.

Jason Bruce Livingood was having an argument with another man in the area of Broadway and First Avenue North around 1:45 a.m. Friday, Sgt. Joe Anderson said.

As the man was walking away, Livingood pulled a gun out of his waistband, pointed it at the man and threatened to kill him, Anderson said.

Police later arrested Livingood at his residence at 902 15th St. N.

Officers located a black BB gun that appeared to be a real pistol, Anderson said.

Livingood was charged in Cass County District Court with terrorizing, a felony.

As police responded to the incident, officers had no reason to believe the weapon wasn’t real, Anderson said.

“Even toy replica guns look extremely similar to real guns,” Anderson said.

The Moorhead City Council is debating whether to make it illegal for a person to carry a facsimile firearm in the city.

Fargo Assistant Police Chief Todd Osmondson said Friday that a similar proposal has not been discussed in Fargo, but his department is watching to see what Moorhead does.

“We don’t want people using replica guns to go in and terrorize and commit crimes, intending that they can get the same impact but hopefully not as large of a penalty,” Osmondson said.

Moorhead council members are expected to discuss the issue again in September or October.
