Fargo man accused of hitting 2-year-old back in jailThe judge warned him.
A 26-year-old Fargo man accused of hitting the 2-year-old son of his girlfriend wasn’t out of jail for three hours before he was back behind bars Monday.
Police say Adam Edward Eberhardt, after posting a $5,000 bond to bail out on a felony child abuse charge, went to his mother’s home at 3001 34th Ave. S., which is less than 800 feet away from the home where the 2-year-old was staying, said Sgt. Joe Anderson.
A no-contact order issued earlier Monday by Judge Steven McCullough made it a crime for Eberhardt to be within 900 feet of the boy.
In an initial appearance on Monday in Cass County District Court, McCullough told Eberhardt to avoid his mom’s home due to its proximity to the boy’s residence, Anderson said.
Jail officials said Eberhardt was bailed out at 5:42 p.m. and booked back in the Cass County Jail at 8:30 p.m. He will make his first appearance today on the misdemeanor charge of violating the protection order.
In court records, police allege Eberhardt struck the 2-year-old on Friday, leaving marks on both sides of the child’s face and popping a blood vessel in his right eye. Eberhardt told police he woke up startled, accidentally hitting the boy.
