Former West Fargo day care owners withdraw appeal

The former operators of a West Fargo day care withdrew their appeal Tuesday to have their license reinstated after it was revoked in April.

Eva and Greg Lynnes, owners of Sunrise-Sunset Day Care, withdrew the appeal during the fourth day of an administrative hearing, said Ron Bedard, an administrator at Southeast Human Services in Fargo.

Kip Kaler, an attorney for the owners, said the couple decided to end the appeal process because “there were just too many administrative and management issues to overcome.”

The North Dakota Department of Human Services sent out a revocation notice in March following an investigation at the day care into complaints ranging from health code violations to force-feeding children. The couple say the allegations were exaggerated and taken out of context, Kaler has said.

Under state law, day care operators who have had a license revoked can reapply for a new license after one year, Bedard said.

Kaler said he did not know of the Lynneses’ plans.
