Robbery charge to be reduced to assaultCass County prosecutors plan to scale back a robbery charge against one of the two men arrested in an incident last month.
Leah Viste, an assistant Cass County state’s attorney, said during a hearing in Cass County District Court on Thursday for Henry Alfred Mitchell that the robbery charge against him will be amended.
Police said at the time that Mitchell and Jacob August Mau assaulted a man they met outside of Big D’s Bar & Grill in Fargo on Jan. 11, taking money from him.
Nicholas Thornton, the attorney for Mitchell, said the felony robbery charge will be reduced to misdemeanor assault. His client is also charged with fleeing police and possessing marijuana and drug paraphernalia, all misdemeanors.
Mau is charged with robbery, and a misdemeanor charge of fleeing police was dismissed last week. His next court date is set for March 11. The next court date for Mitchell, 40, of Fargo, is set for April 14.
