JT Cigarro case in hands of Fargo health officialsFargo’s city attorney said Wednesday that the Liquor Control Committee no longer needs to consider whether the new JT Cigarro bar and retail tobacco store violated a city ordinance.
Erik Johnson said it’s in the hands of Fargo health officials to investigate a potential violation of the city’s smoking ban at the business, 4554 7th Ave. S.
Fargo Cass Public Health and bar owners voiced concerns to the committee in August about JT Cigarro’s bar and its separate retail store being located within the same building because of the risk that cigarette smoke from the store could possibly infiltrate the smoke-free bar.
JT Cigarro owner Dana Coulter said previously that he had installed an air-handling system that prevented smoke infiltration between the tobacco store and the bar.
But Fargo Cass Public Health will continue investigating the business, and if any evidence is found that smoke is infiltrating the bar, the matter will be forwarded to city prosecutors, Johnson said.
