Waubun man sentenced for criminal sexual conduct

Daniel Kevin Finn, 49, of 39544 Oxbow Road, Waubun has been sentenced on felony count of fourth-degree criminal sexual conduct. He was also sentenced for fifth-degree criminal sexual conduct.

He was found guilty on both counts by a jury on Feb. 25.

According to court records:

On March 29, Finn went to Oxbow Resort on Elbow Lake in Becker County with two young men, ages 18 and 19, after enlisting their help in unloading furniture.

They first went to Brainerd to pick up the furniture. Finn allegedly purchased beer and hard liquor there as well.

Upon arriving at Oxbow, it was too late to unload, so they stayed overnight.

The three played drinking games and the two younger men became extremely intoxicated, according to court records.

After they went to bed, partially clothed, Finn allegedly rubbed the back, legs and groin area of the 19-year-old while he was passed out, and reached over and touched the sexual area of the 18-year-old through his clothing, according to court records.

The 18-year-old was frightened and didn’t know what to do, so he feigned sleep and turned away, and when Finn left the room he woke up the 19-year-old, told him what happened and they left the resort unobserved.

On Wednesday, District Judge Joe Evans sentenced him to 24 months in prison, execution of sentence stayed 10 years. He was placed on supervised probation for 10 years.

He was ordered to serve 180 days in jail, with credit for three days served. Work release privileges were granted.

He was fined $1,000, plus court fees, on each count.

He must get a chemical use assessment and follow the recommendations, abstain from drugs and alcohol, have no contact with the victims or their families, submit to random drug testing, and register as a sexual predatory offender.
