West Fargo rape case dismissedA judge has dismissed a case against an 18-year-old man accused of raping a 24-year-old woman with the help of another man in West Fargo.
Prosecutors filed a motion last week seeking the dismissal, citing new developments in the case, Cass County District Court documents state.
DNA results did not match Jesus Ponce-Reyes, who was previously charged with felony gross sexual imposition in connection with the Sept. 29 incident at Sunset Motel.
“Given such circumstances, there is now reasonable doubt that the defendant committed the offense he is charged with,” prosecutor Reid Brady wrote in the dismissal filing.
Ponce-Reyes is still being held at the Cass County Jail pending immigration proceedings. He is in the country illegally, court documents state.
